Rhode Island Froze a $150M Sludge Pyrolysis Plant Over a Control Efficiency Nobody Could Measure

Page 17 of Rhode Island's air permit review for QSS Biosolids says more about why the project is frozen than any of the legislative testimony did. The paragraph isn't about QSS Biosolids at all. It describes a different plant, in the same industrial park, owned by the same people: a wood-chip-to-biochar unit approved under Nos. 2552-2563 on 15 May 2023. That plant, the state's reviewer wrote, was not built as designed in the permit application, and the efficiency of its thermal oxidizers to achieve 99.9 percent control could not be measured. Nobody could sample the gas going into the oxidizer, so the ratio the permit demanded could never be computed. So a plant approved in 2023 on a destruction-efficiency claim later failed to produce the one measurement its permit required, and the state quietly rewrote the requirement around it. The politics arrived anyway. On 11 June 2026, its final day in session, the Rhode Island General Assembly passed a one-year moratorium on sewage sludge processing facilities (Senate Bill 3224) and stood up a 21-member study commission to report by 1 April 2027 (Senate Bill 3225). That freezes QSS Biosolids' proposed $150 million sludge pyrolysis plant at Quonset Business Park until at least the middle of 2027. The company had a lease from November 2024 and a state air permit issued 16 January 2026. Four days after the vote, the town of North Kingstown served notice that it intends to sue EPA over the facility's federal Clean Air Act classification.
I've spent most of my career on the issuance side of this, and the instinct there is to treat a signed permit as the end of the argument. It isn't. It's the beginning of the part where everybody else gets to read your file.
What Page 17 Actually Says
Read the QSS Biosolids review the way an opponent's engineer would and the sequence is unflattering. During the technical review, the sister company came to the Office of Air Resources with a problem at the wood-chip plant: the oxidizers weren't achieving demonstrable control because the inlet stream couldn't be characterized. The state's fix was pragmatic. Drop the efficiency requirement, and instead require the operator to measure specific VOC species at the outlet and show they land under the rates the application had calculated using the 99.9 figure. Reasonable engineering judgment. But it leaves a permanent record that the number was never verified.
"The construction of the pyrolysis and thermal oxidizers at this plant were not built as designed in the permit application and due to several issues, the efficiency of those thermal oxidizers to achieve 99.9 percent control could not be measured. Specifically, the pollutants entering the oxidizer could not be measured therefore the control efficiency could not be determined as required in the permit." Then it propagated. QSS Biosolids told the state that the control efficiency in its own application couldn't be measured either, for the same reasons. Its application had claimed 99.99 percent VOC destruction across the pyrolysis gas train. The reviewer did the right thing and asked for a written performance guarantee from the equipment manufacturer at that number. On 1 December 2025 the answer came back: the vendor would guarantee 99.9 percent.
One decimal place. That single digit raised the potential to emit for a list of VOC species, pushed acetaldehyde and phenol over Rhode Island's Minimum Quantity trigger, and forced a fresh air dispersion modeling run, submitted 9 December 2025, covering 25 pollutants. And there's a detail I'd flag to any lender reading the file: as of a 2 December 2025 email from the applicant's consultant, the manufacturer for the air pollution control equipment had not been selected. The permit was issued on performance figures for machines nobody had bought yet, with a note that a permit revision might be needed once they were.
None of that is scandalous. Permits get written this way constantly, especially for first-of-a-kind units where the vendor package is competitively bid after financing. Yet what's different here is that the same file also contains a nearby plant, same ownership, where exactly this arrangement produced an unverifiable number. A hostile reader doesn't have to allege anything. They just have to quote you.
Minor Source Is Something You Do, Not Something You Are
The arithmetic underneath a sludge pyrolysis minor-source designation deserves a wider audience than it's getting. Two electrically heated reactors, roughly 159 tons a day of sewage sludge, an odor control plant on the front end and two thermal oxidizers with catalytic filters on the back. Uncontrolled, the facility's VOC emissions were calculated at about 3,218 tons a year. The major source threshold that matters here is 50. Controlled, the whole facility lands near 5 tons a year of VOC, comfortably minor, and every criteria pollutant clears its threshold with room to spare.
So the gap between "minor source" and "major source, full Title V, offsets, PSD review" is a single engineering assumption applied to equipment that hadn't been procured. Particulate runs the same shape: about 711 tons a year uncontrolled, roughly 6.5 controlled. Sulfur dioxide, 244 uncontrolled to 37. These aren't sloppy numbers. And that's the point, because they're standard practice. Minor-source status in this sector is almost never a property of the process. It's a property of the abatement train, and abatement trains have bad months.
There's a second number in the file I'd have circled in red if I were still on the state side. Greenhouse gases from the plant come to 87,232 tons a year of CO2 equivalent. The Title V major source threshold for GHG is 100,000. That's about thirteen percent of headroom on a facility whose reactors are electrically heated and whose owner has an adjacent sister operation. North Kingstown's Clean Air Act notice argues that EPA should have accounted for related facilities, shared infrastructure, common ownership, and future expansion including increased electricity generation. Whatever you think of the town's motives, that is not a frivolous theory, and the file supports the factual premise: there isn't much room between where this plant sits and where the major-source obligations start.
In 2024 I lost the better part of a year on a PFAS air permit review when the state dropped a monitoring condition into the middle of the cycle that the installed CEMS physically couldn't satisfy, and we spent those months proving an alternative method was equivalent. My mistake was reading the condition as a paperwork item rather than a hardware spec. A permit condition that your installed instruments can't produce a number for isn't a condition at all. It's a paragraph, and it will come due at the worst moment. The year before that, a Title V renewal I was advising on turned a "minor" modification into eight months of PSD review, which taught me the same lesson from the other direction.
The classification question sitting underneath all this, whether a pyrolysis unit is legally an incinerator, is genuinely unsettled at the federal level. I've argued elsewhere that EPA's handling of the pyrolysis definition inside an air curtain rule left the regulated community guessing. Rhode Island didn't wait for that fight to resolve. The state accepted EPA's determination that the process isn't incineration, then permitted the plant as a minor source under its own BACT rule at 250-RICR-120-05-9.7.3, and the legislature overrode the whole thing on political grounds ten months later. Getting the federal question right bought QSS almost nothing.
The Moratorium Was the Cheap Outcome
Rhode Island has a real disposal problem and everyone involved knows it. The state currently burns its sludge in two places: Cranston's multiple hearth incinerators and Woonsocket's fluidized bed, and Woonsocket has signaled it wants out. Hauling and tipping wet cake out of state runs somewhere between $45/ton and $120/ton depending on distance and the receiving site's appetite [industry range], and New England's appetite is shrinking as land application programs tighten under EPA's biosolids risk work and 40 CFR Part 503 comes under pressure. A sludge pyrolysis plant that turns 159 tons a day of cake into biochar is a rational answer to that problem. It may still be the right project.
What it didn't have was a defensible sequence. Opposition to a thermal facility almost never arrives as a single event, and this one escalated in three legible steps over about fourteen months: neighbors organizing after the lease became public, then a suit filed in April 2026 against the state agencies that approved the siting, then the legislature. Each rung gave the developer a chance to put verified operating data in front of somebody. There wasn't any, because the plant hadn't been built and the sister facility's numbers had already been rewritten once. By the time a bill is drafted, the technical argument is over; you are arguing about trust with people who have read your permit file more carefully than your investors have.
The developer's job wasn't finished when the permit was signed, and the thing that would have helped isn't better outreach. It's measurability. If the inlet to the oxidizer can't be sampled, the design should have included the sample port and the isokinetic access before the application went in, even at a cost premium, because the destruction efficiency is the entire basis of the minor-source claim and therefore the entire basis of every reassurance the company was offering at public meetings. The vendor guarantee should have been in hand at submittal, not extracted from the reviewer's insistence six weeks before issuance. Design for the audit you'll face, not the one in the regulations.
Where does this analysis not hold? Smaller units, under roughly ten tons a day, generally stay below the thresholds that make any of this bite, and their permits are correspondingly thin. States with delegated programs that require pre-construction vendor certification (some western states are stricter than Rhode Island here) already close this gap. And a plant whose abatement train can be tested at the inlet has a genuinely different risk profile from this one; my argument is about unverifiable control claims, not about pyrolysis. And projects with a measurable stack plus two years of clean data behind them tend to survive local opposition, because there's something to point at. Modern pyrolysis systems can be instrumented well. Most permit applications simply don't require it, and no developer volunteers a compliance obligation.
The commercial reading is bleaker than the regulatory one. A one-year freeze on a $150 million project with a signed lease is not a one-year cost. It's an interest carry, a re-bid of an equipment package that was already unselected, a renegotiation with whichever municipalities were going to send feedstock, and a study commission that reports in April 2027 into an election year. Anyone selling zero-waste-to-landfill solutions into a US municipal market should price that sequence into the development budget rather than the risk register. In my experience the diligence packs that lenders accept as ESG compliant projects almost never contain a line for "the legislature ends this," and they should, because in the last three years it has become one of the likelier outcomes for a thermal facility inside a residential drive time.
The study commission will sit down sometime this fall with 21 seats and a March deadline. Somebody in that room will eventually ask the only question that matters: how would we know if this plant were working as promised? The honest answer available today is that the operator would tell us, using a number its own vendor guarantees but nobody at the fence line can check. Does anyone think a commission convened by a legislature that just voted unanimously to stop the project will find that answer sufficient?
